Digital sovereignty and fundamental rights: A European model of Internet Governance

Abstract

The article describes and analyzes the recent regulatory turn in the European Union’s digital policies, and the attempt of the European institutions to advance a new model of global Internet governance. The analysis suggests that the peculiarity of this model comes from the combination of two different normative frameworks: digital constitutionalism and digital sovereignty. More in detail, new EU legislative proposals testify how the regulative endeavor of the European institutions aims, on the one hand, at defining an ensemble of fundamental digital rights, and on the other, at the establishment of a set of public powers able to limit the exercise of digital power.
