“Algorithmic” direction of workers in logistics procurements. Towards a changing jurisprudential framework

In the logistics sector, where work is often transferred to third parties through procurement contracts, the use by principal companies of IT systems for the management and control of workers formally employed by the contractors is increasingly common. Some recent judgments of trial courts has considered the need to update the criteria traditionally elaborated by the Supreme Court in terms of the lawfulness of the contract, enhancing the ownership of the IT system to impute employer powers to the client company.
